Terms and Conditions

These terms and conditions apply to the use of the Give a Guru website found at www.GiveaGuru.com.au.

These terms and conditions specifically refer to the following products and services, which may be purchased or accessed via our website:

Service Provider: Third party provider of the Service to the Recipient.
Service: Agreed activities and deliverables provided by the Service Provider to the Recipient as outlined in the Gift Package.
Give a Guru: An intermediary between Service Providers and Customers, acting as a reselling agent for Service Providers.
Purchaser: A member of the public who has purchased the Service. The Purchaser can also be the Recipient.
Recipient: A member of the public for whom the Service is to be executed.
Gift Voucher: A contract of sale with individual Service receipt. Credit note to the value of the Purchase Order or of fixed value.

1. Making a Purchase

When you purchase and/or use a Give a Guru Gift Voucher and tick the box that says ‘I understand and accept the Terms and Conditions’, you become legally bound by these terms and conditions. Please do not proceed to purchase/use your Give a Guru Gift until you have read, understood and accepted these terms and conditions. 2. Prices

Give a Guru reserves the right to change prices without notice. All prices include Goods and Services Tax (GST) at the current rate of 10% in Australia. All orders carry a flat transaction fee, which is clearly highlighted on the final payment screen.

3. Transfer of Give a Guru Gifts

All valid and unused Give a Guru Gift Vouchers are eligible to be fully transferable.

Conditions for transference to another recipient are as follows:

1. The voucher is still valid and has not yet been exchanged or used.
2. Proof of purchase is provided; either an order number, purchaser’s full name or purchaser’s email address.
3. Give a Guru is able to correctly verify you as the original Recipient.

Please note it is the Recipient’s responsibility to obtain and provide Give a Guru with all required verification details. Failure to do so will result in replacement voucher not being issued.

Please call our customer service team on 1300 02 44 82 to transfer your gift voucher to another Recipient.

Note: Give a Guru accepts no responsibility for any stolen or fraudulent Gift Vouchers. It is the holder’s responsibility to ensure the safe keeping of their Gift Voucher(s).

4. Lost Gift Vouchers

If a Gift Voucher is received and subsequently lost, the Recipient may be eligible to have a replacement voucher emailed to them.

Conditions for replacement of lost Give a Guru Gift Vouchers:

1. The voucher is still valid and has not yet been exchanged or used.
2. Proof of purchase is provided; either an order number, Purchaser’s full name or Purchaser’s email address.
3. Give a Guru is able to correctly verify you as the original Recipient.

Please note it is the Recipient’s responsibility to obtain and provide Give a Guru with all required verification details. Failure to do so will result in a replacement voucher not being issued.

5. Expiry & Extensions: Gift Vouchers

Gift Vouchers must be used (date booked and service taken) within 12 months of purchase.

1. A 30 day grace period is applied following the expiry date.
2. The Service must be booked and taken within the 30 day grace period.
3. Vouchers cannot be redeemed past the 30 day grace period.

Expired vouchers are non-refundable in whole or in part. After a voucher has expired, it is no longer valid and all transaction attempts will be declined. Any unused value at the date of expiry will become the property of Give a Guru.

The expiry date is clearly displayed on all Gift Vouchers.

Conditions for Extension:

• If your Gift Voucher expired LESS THAN 30 DAYS ago, a 30 day grace period from the date of expiry may be applied on request. Please call our Customer service team on 1300 02 44 82 to arrange.
• If your Gift Voucher expired MORE THAN 30 DAYS ago, extensions are not permitted.

6. Gift Voucher Delivery

Give a Guru is not liable or responsible for any loss suffered as a result of a Gift Voucher not being delivered as a result of an incorrectly entered delivery date, email address or as a result of the email being blocked by filters or firewalls. If the recipient does not receive the email Gift Voucher, please contact us immediately on 1300 02 44 82 to send the Gift voucher to an alternative email address.

7. Providers of Services

• Gift Vouchers are sold by Give a Guru who acts as an agent for Service Providers.
• Give a Guru is not a provider of such services and has no responsibility for any services provided or not provided by the Service Provider or any other party.
• The Service Providers provide services directly to customers.
• Give a Guru makes no warranty or representation regarding the standard of any service to be provided.
• All Give a Guru vouchers are issued subject to the terms and conditions of each Service Provider and these Give a Guru terms and conditions.
• Give a Guru does not control the business operations of any Service Provider.
• Give a Guru makes no guarantees or warranties about the Services that are provided to you by the Service Providers.

8. Give a Guru’s Liability

Give a Guru has:

• no liability for any act, omission or default, whether negligent or otherwise of any Service Provider or third party.
• no liability for any loss or damage occasioned by any negligent act or omission of any Service Provider or third party.
• Where Give a Guru’s liability cannot be excluded, such liability is limited to the value of the Gift Voucher purchased.

9. Availability of services

All services are offered by Service Providers subject to availability. Bookings should be made at least 3 weeks in advance. If the Recipient would like to book during peak times (such as weekends or holidays), it is suggested booking are made as soon as possible. Bookings are not finalised until the Recipient has received the email entitled “Confirmation of your booking”.

10. Contact details given to Service Providers

It is the Recipient’s responsibility to ensure the email address provided and other contact details are correct when completing the “Request for Service” booking process on the Give a Guru website. Failure to do so may result in loss or incorrect delivery of the email confirmation of the service. As the Service Provider will be expecting to meet with the Recipient, they may end up forfeiting the voucher (subject to the Service Provider’s terms and conditions).

11. Booking Cancellations

Once a booking has been made, if the Recipient cancels it, they may incur a cancellation fee from the Service Provider. Our Service Providers have their own cancellation policies, which the Recipient is bound to follow. If a Service Provider needs to cancel a Service for any reason, the Recipient will be notified as soon as possible in order to reschedule a convenient alternative date. Give a Guru will not reimburse any travelling, accommodation or other expenses incurred by the Recipient or any other person in the event of a cancellation.

12. The Weather

Some Services may be weather dependent. The Recipient will have the Service Provider’s details to confirm whether adverse weather affects the proposed Service. Please call on the morning of the Service to allay any doubt about the weather suitability. If bad weather affects a booking it will be rescheduled at no cost. The booking must be reschedule as the voucher is non-refundable.

13. Complaints or Problems During Your Service

If the Recipient has a problem or a complaint on the day of the Service, please bring this to the Service Provider’s attention immediately so that issues may be addressed on the spot, where possible.

14. Insurance

Some of the Services may be considered dangerous. Prior to ordering or participating in any Service Recipients should be aware of the risks involved. Give a Guru can provide further information if there are any doubts about any Service. Service Providers warrant that they maintain appropriate public liability insurance for all risks associated with their business and service provisions. Give a Guru makes no warranty or representation about their business or services whatsoever. The responsibility rests with the Recipient to make independent enquiries with the Service Provider or other third parties as to the need to acquire their own insurance cover.

15. Descriptions of Services

Independent Service Providers provide the information about their Services. Give a Guru tries to ensure that our promotional information is accurate and up-to-date. However, the content or format of some Services may change slightly from time to time. The Service Provider (upon confirmation of each booking) will provide the final details about each Service. The Service Provider will notify the Recipient of any subsequent changes. The Recipient’s participation in each Service is conditional upon acceptance of the Service Provider’s terms and conditions at the time the booking is confirmed by the Service Provider.

16. Illustrations on Our Sites

The photographs used on our websites to illustrate Services are used as an indication only.

17. Service Locations

Give a Guru currently operates in Greater Melbourne, to ensure the Service is available in the gift Recipient’s area simply enter the postcode or suburb when prompted on our site to view available gift packages.

18. Service Session Length

Service session lengths are approximate and are provided by Service Providers as a guide only.

19. Restrictions on accepting Services

Certain Services provided by Service Providers are subject to minimum age, weight, health or other restrictions. These restrictions are outlined on the relevant Service information page under “Need to know”. Please read this information carefully. It is your responsibility to understand any restrictions prior to confirming your booking. If you are later forced to cancel due to restrictions, you may be liable for charges by the Service Provider of your Service.

20. Promotional Offers

Give a Guru offers promotional discounts and special offers from time to time (‘Promotional Offers’ or ‘Promotional Codes’). If you have a Promotional Code, it should be entered at the final payment screen where prompted. By redeeming any of Give a Guru’s Promotional Codes or Promotional Offers, you agree to accept and comply with all of the following terms and conditions of use.

1. All discounts arising from Promotional Offers (percentage or dollar discounts) and Promotional Codes can be are applied to transactions during payment.
2. If you have been provided a valid Promotional Code, you must enter it into the designated field in the shopping cart. Otherwise, your discount will not be applied.
3. Promotional Codes must be used before the designated expiration date. No extensions will be allowed under any circumstances.
4. Promotional Codes and Promotional Offers cannot be combined.
5. Unless otherwise specified Promotional Codes may only be used once per person.
6. Where multiple Promotional Codes are offered, only one can be used per transaction.
7. Where multiple discounts apply, the user will receive the maximum discount available.
8. Give a Guru reserves the right to verify the validity of Promotional Code use at any time. If there has been (or we have reason to believe there has been) any unauthorised use we will immediately cease all activity on your Account.
9. Give a Guru reserves the right to remove any Promotional Offer or Promotional Code without notice at any time.

21. Other Information

The text and illustrations (including photographs) used by Give a Guru are protected by copyright and must not be copied in whole or in part with the express permission of Give a Guru.

22. Give a Guru Legal Entities

The Give a Guru (www.GiveaGuru.com.au) is owned and operated by Give a Guru Pty Ltd (ABN 15 321 771 302) herein referred to as “Give a Guru”. We reserve the right to change these terms and conditions without notice.
